6. Real Estate Listings, IDX, and MLS Information

If this Site displays real estate listings, IDX data, MLS information, property information, market data, or similar real-estate Content, that information may originate from:

  • multiple listing services;

  • brokers;

  • agents;

  • property owners;

  • builders;

  • public records;

  • listing providers;

  • data vendors; or

  • other third-party sources.

Real-estate information may change rapidly.

A property displayed as available may already be under contract, sold, withdrawn, unavailable, or otherwise changed.

Property details, square footage, boundaries, school information, taxes, assessments, association information, pricing, availability, measurements, features, and other information should be independently verified where material.

The display of real-estate information does not by itself create:

  • an agency relationship;

Unless otherwise stated, recurring subscriptions may continue until cancelled.

You are responsible for cancelling before the next renewal if you do not want the subscription to renew.

We do not warrant that every listing, review, data point, AI response, message, price, availability statement, third-party service, or other item on the Site is accurate or current.

Nothing in this section excludes a warranty or right that applicable law does not permit us to exclude.

30. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOIN REWOW, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR LOST-PROFIT DAMAGES ARISING OUT OF OR RELATING TO USE OF THE SITE.

This includes loss of:

  • profits;

  • revenue;

  • data;

  • goodwill;

  • opportunity;

  • expected savings; or

  • business.

To the maximum extent permitted by law, our aggregate liability arising from or relating to the Site will not exceed the greater of:

(A) the amount you paid directly to JOIN REWOW for the specific Site product or service giving rise to the claim during the three months before the event giving rise to the claim; or

(B) USD $100.

Where applicable law does not permit a particular limitation, that limitation applies only to the maximum extent permitted.

Nothing in these Terms limits liability that applicable law prohibits us from limiting.

31. Technology Provider Limitation

To the maximum extent permitted by law, JOIN REWOW and other independent infrastructure or technology providers are not responsible for:

  • the accuracy of JOIN REWOW's Content;

  • JOIN REWOW's professional services;

  • products sold by JOIN REWOW;

  • representations made by JOIN REWOW;

  • independent third-party businesses appearing on the Site;

  • agreements between you and JOIN REWOW; or

  • agreements between you and another third party.

Nothing in this section alters obligations that a technology provider independently owes under applicable law or under an agreement directly between you and that provider.

32. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless JOIN REWOW and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from:

  • Content you submit;

  • your unlawful use of the Site;

  • your fraud or intentional misconduct;

  • your infringement of third-party rights;

  • your violation of these Terms; or

  • your violation of applicable law.

You are not required to indemnify a party for liability to the extent caused by that party's own conduct where applicable law prohibits such indemnification.

33. Suspension and Termination

We may suspend or terminate access to Site functionality if we reasonably believe:

  • you violated these Terms;

  • your activity is fraudulent or abusive;

  • you pose a security risk;

  • payment is overdue or disputed;

Termination does not eliminate obligations or liabilities that arose before termination.

Electronic records, checkboxes, clicks, form submissions, Account activity, emails, and other electronic actions may be used to evidence transactions and agreements.

You are responsible for maintaining accurate contact information when an account or transaction requires it.

35. Changes to These Terms

We may update these Terms from time to time.

The current Terms will display:

Changes become effective when posted or on another effective date stated with the updated Terms, subject to any notice requirements imposed by applicable law.

If you continue to use the Site after updated Terms become effective, the updated Terms apply to your continued use to the extent permitted by law.

36. Severability

If a provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted or modified to the minimum extent necessary, and the remaining provisions will remain in effect.

37. No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

Separate agreements between you and JOIN REWOW remain effective according to their terms.
